Welcome to Agendova. By using our mobile application (the “App”), our website, and its associated services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.

1. Description of Service

Agendova is a Software-as-a-Service (SaaS) platform designed to help businesses and professionals manage their appointments, schedules, and client communications. The Service is provided “as is” and “as available.”

2. Account Registration and Security

  • Eligibility: You must be a legal business entity or a professional individual (18 years or older) to use the Service.
  • Account Creation: We use secure third-party providers for authentication. You agree to provide accurate, current, and complete information during the onboarding process (Name, Business Name, Email, and Phone Number).
  • Security: You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately at hello@agendova.com of any unauthorized use.

3. User Responsibilities

As a business user of Agendova, you agree:

  • Accurate Information: To maintain accurate business details, including services, pricing, and availability.
  • Legal Compliance: To use the Service only for lawful purposes and in accordance with your local laws and regulations (including consumer protection and data privacy laws).
  • Client Communication: To ensure that you have obtained the necessary consent from your clients before sending them automated reminders or notifications via WhatsApp or Email through our platform.

4. Subscriptions and Payments

  • Fees: Agendova offers free and paid subscription plans. You agree to pay all fees associated with your chosen plan.
  • Billing (Web): Payments made through our website are handled securely via Stripe.
  • Billing (Mobile): Payments made through our mobile application are processed via the Apple App Store or Google Play Store (In-App Purchases).
  • Refunds: Fees are generally non-refundable unless required by law or specified within the specific terms of the payment platform used.
  • Changes: We reserve the right to modify our fee structure at any time, with prior notice provided to you.

5. Intellectual Property

  • Our Content: All rights, title, and interest in and to the Service (excluding your business data and logos) are and will remain the exclusive property of Agendova.
  • Your Content: You retain ownership of any logos, business names, and service descriptions you upload. By using the Service, you grant us a limited license to host and display your content to provide the Service to you and your clients.

6. Service Limitations and Liability

  • Downtime: While we strive for high availability, we do not guarantee that the Service will be uninterrupted or error-free.
  • Business Losses: Agendova shall not be liable for any indirect, incidental, or consequential damages (including loss of profits, business interruption, or loss of data) arising from your use of the Service.
  • Third-Party Tools: We integrate with third-party infrastructure and service providers. We are not responsible for the performance or availability of these external providers.

7. Termination

  • By You: You may terminate your account at any time by contacting us or using the in-app deletion tools.
  • By Us: We reserve the right to suspend or terminate your access to the Service for violations of these Terms or for non-payment of fees.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use your data. By agreeing to these Terms, you also acknowledge our Privacy Policy.
